1. Terms and conditions
The agency’s terms and conditions must be signed and returned by the client previous to any
castings/bookings. All bookings will be confirmed in writing as a booking form. Failure to
acknowledge the booking forms will be deemed to be an acceptance of the booking and
these terms and conditions.
2. Fees
Fees are based on either an hourly rate, a half day rate (up to 4 hours) or a full day rate (up
to 8 hours) agreed at time of booking. Overtime rates will apply outside of these hours.
Agreed expenses will be added where appropriate and VAT is charged on all bookings.
An additional fee will apply to usage which is not permitted. Permitted usage includes
editorial, press advertising and leaflets/ brochures. Exclusions are listed below in usage fees.
3. Copyright
The copyright of any images taken belong to the photographer. Usage of the photos
(Section 6) are based on the agreed usage prior to the booking. The photographer, if not in
house, may also have their own usage rights. Where possible, we request copies of the
images to be sent to us, The Agent, for models portfolio and agency blog.
4. Models
Models are contracted for work through DNA Models LTD (Trading as DNA Models and
PK Model Agency). It is forbidden to contact or book models direct. Communication shall
bypass the agency and under no circumstance should the client contact the model directly
without permission off the agency.
5. Overtime
Additional fees are applied to any overtime worked over the booked hours (Half Day: 4
hours, Full Day: 8 hours). Fee is worked out on an hourly basis dependent on the daily rate.
6. Usage fees
Additional fees apply for the following (unless otherwise agreed); Public transport, TV
commercials/Broadcasting, Catalogues, Packaging, billboards and World Wide Web. The
client is responsible for negotiating the additional rate payable at the time of booking.
Unless otherwise agreed these additional fees will be for the UK only for a period of one
7. Cancellation fees
A 50% fee will be charged for all cancellations made within 48 hours (working days MonFri) prior to commencement of booking. A 100% fee will be charged with cancellations
made less than 24 hours prior to booking.
8. Invoicing/payments
New clients may be required to pay 50%/100% of booking fee prior to commencement.
Existing clients will be required to pay within 30 days of invoice. In all cases, the person
booking the model is the client, who will be invoiced and solely responsible for payment,
unless otherwise agreed in writing.
9. Meals
Clients are responsible for the provision of all meals and beverage requirements of the
models (taking into account dietary requirements) whilst the models are providing services
to the client on all bookings.
10. Model care and safety
10.1 The clients shall ensure that the model is treated with respect and professionalism and
that the client takes all steps necessary to ensure that the safety, health and well being of the
model is protected and maintained at all times whilst providing services to the client. Such
steps shall include without limitation:
10.1.1. ensuring that the venue for the provision of the services and the working
conditions are safe and secure and allow the model to provide the services in compliance
with all health and safety standards, regulations, codes and laws;
10.1.2. allowing the model to take suitable and regular rest periods, to ensure the
model is able to maintain suitable amounts of rest and refreshment whilst delivering the
10.1.3. providing adequate levels of insurance cover to safeguard the health and
safety and future earnings of the model whilst the model is delivering the services and
travelling to and from the client’s venue as if he/she were an employee of the client;
10.1.4. ensuring that all of the people and organisations which are engaged by the
client in relation to the delivery of the services are suitably qualified, experienced and
10.1.5. ensuring that no one imposes upon the model any action or activity which is
either dangerous, degrading, unprofessional or demeaning to the model;
10.1.6. providing the model with an appropriate changing and dressing area to ensure
that the model can prepare for the provision of the services and also maintains his/her
10.2. Always include a credit as “model’s name” @ “the Agency”, wherever a credit
is applied.
11. Child Model Care (In Addition)
11.1. All staff members in contact with the child model must be DBS Checked
(photographer/stylist etc).
11.2. The child must always be in the presence of their chaperone (usually parent). If the
parent does not have access to certain areas, a chaperone must be provided, this information
must be given to the agency prior as all chaperones must be stated on their licence.
11.3 Separate dressing areas must be provided.
11.4 Performance Restrictions:
Age On Set Permitted Times Continuous Work
0-4 years 5 hours between 7am-10pm 30 minutes
5-8 years 8 hours between 7am-11pm 2.5 hours
9 + 9.5 hours between 7am-11pm 2.5 hours
11.5 Breaks:
Age Minimum Intervals
0-4 years Any breaks must be for a minimum of 15 minutes. If at the place of
performance or rehearsal for more than 4 hours, breaks must include at least
one 45 minute meal break.
5+ If present at the place of performance or rehearsal for more than 4 hours but
less than 8 hours, they must have one meal break of 45 minutes and at least
one break of 15 minutes
If present at the place of performance or rehearsal for 8 hours or more, they must
have the breaks stated above plus another break of 15 minutes.
12. Licensing
Children under the age of 16 require a performing licence to take part in any assignment.
The agency require 21 days notice to complete the license. Any bookings with less than this
notice period may be subject to the council refusing to complete the licence and therefore
refuse the child to take part. The client must have a hard copy of the licence in case of any
spot checks by the councils.
13. Liability and insurance
13.1. No party excludes or limits its liability under these terms and conditions for: <
13.1.1. death or personal injury caused by its negligence;
13.1.2. fraudulent misrepresentation; or
13.1.3. any other type of liability which cannot by law be excluded or limited.
13.2 The Agency shall not be liable for:
loss of business, use, profit, anticipated profit, contracts, revenues, goodwill or anticipated
product recall costs;
failure by the model to attend a booking for whatever reason;
damage to the client’s reputation;
consequential, special or indirect loss or damage;
even if the Agency has been advised of the possibility of such loss or damage
14. Complaints
Any cause for complaint must be reported to the agency by the client as soon as it arises.
Complaints cannot be considered and/or dealt with effectively after the services have been
delivered. Therefore any complaints must be received no longer than 3 hours after booking

A. Definition

Model: Any individual to whom the agency provides services to include photographic,
fittings, catwalk and filming. For children under 16 “model” refers to the parent/guardian
who is to act on the models behalf.

1. Model

1.1 Models hired to work on our agency are contracted to work on a self employed basis.

1.2 Models are contracted on a non exclusive basis and free to join agencies outside of a
10 mile radius.

1.3 Direct contact with the client is strictly forbidden and will result in immediate
termination and possible legal action.

1.4 Any change to the models appearance or size must be updated with the agency,
regarding new images (please see 5.1)

1.5 Measurements must be updated with the agency on a regular basis and/or when
requested or any changes occur.

Measurements are to be received through the measurement update form only and in
the following months:

0-10 years: January – April – July – October
11+ years: January – July

A reminder will be sent at the beginning of the month via email and the measurement
form must be received by the end of the month.

1.6 Failure to comply to 1.4 & 1.5 may result in website representation temporarily
terminated until update is completed, or termination in full.

2. Agency

2.1 The agency undertakes to act on the models behalf regarding the organising of client bookings.
2.2 The agency is authorised to accept monies from the client/hirer on behalf of the model.
2.3 Agency fee’s are charged direct to the client and not taken from the models rate as commission.
2.4 The Agency will represent models via website representation providing they obtain a website portfolio. (please see section 5)

3. Representation

3.1 PK Models contract includes free representation.
3.1.1 Minimum of 1 year representation and maximum until they turn 18 years of age. Providing a model course is completed ages 3+ (3.5 and 8) and portfolio
is updated yearly (5.6)
3.2 The agency will evaluate the model yearly: Current appearance/temperament/measurements.
3.3 No termination period is required from the model for terminating. The agency has a
1 year period (3.1.1) after which no termination period is required.
3.4 A breach of these terms will void section 3.1 and result in immediate termination.
3.5 Compulsory – Free 6 week model course, for ages 3 years and over (See 8.1 for further details)
3.5.1 For models who joined prior to September 2015 (under baby enrolment) the model course is not free and is charged at a 50% discounted price of £10.50.
This is still compulsory.
3.6 Representation offer is only valid for 30 days, booking your photographic session must be completed within 30 days otherwise offer is terminated and reapplication would be required.

4. Website

4.1 For website representation, our page is open to the public with the models full name visible unless otherwise agreed.
Age will be displayed on profile as years and months e.g.. 2 yrs 2 mths.
4.2 Models representation includes free website representation.
4.3 Search Engines (Google etc.) search websites and display content on their pages.
Profiles and Images will be live on the World Wide Web. When removed from our website, images may still be visible for an indefinite period until the memory ceases to exist.

5. Portfolios

5.1 Website portfolio’s are compulsory for website representation and provided with our in house photographer for £95. PK Models receive updates at a 50% discount off this rate.
5.1.1 Group Portfolio days for updates are on offer for PK Models aged 3+. The
cost of portfolio days are £85.
5.1.2 Portfolios take place at Jules Photography’s studio:

5.2 Portfolio’s include 8 high res Images, These include copyright to print up to A4. 8 Images are provided dependant on the models performance on the day.
5.3 A booking fee of £40 (£30 for Updates) is taken in order to secure your chosen photographic session. This is non refundable. The remainder is payable on the day of the session prior to session commencement.
5.4 Portfolio Cancellations must be made with no less than 48 hours notice prior to the booking commencement. With notice the booking fee will be transferred over to the next photographic session, provided it is booked within 30 days of cancellation. Only one transfer of booking fee is permitted. Cancellations with less than 48 hours notice,
or no shows will loose the booking fee and may result in the cancellation of PK
Models Representation Offer/Representation.
5.5 Please note you are paying for a time slot, if your child refuses to have their photo taken and the 8 images are not achieved (5.2) the full balance is non refundable.
5.6 Website Portfolio’s must be updated (at models cost) once a year minimum. Failure to update images will result in the Agency terminating website representation (please see 1.4)
5.7 The 8 images chosen at your photo session are the final 8 images used for your child’s portfolio. Once chosen we cannot change the 8 images. If you wish to change your mind after the session there would be a charge of £10 per changed image.
5.6 Images are received via dropbox link to your email two weeks after the shoot. The 8 chosen images are then used to represent the models on our website (4) and will be live around two weeks after the shoot.

6. Bookings

6.1 Written communication with the model will be made on all assignments to include job specification and fee. Written confirmation will be sent prior to assignment.
6.2 Any complaints will have to be investigated and appropriate action taken at the time.
6.3 The agency will not be held responsible for a models behaviour or conduct during an assignment. Therefore will not be held liable for any costs, expenditures or losses suffered as a consequence.
6.4 Models should expect a 3 month window from date of booking to receiving monies.
6.4.1 Payment should not be chased until 60 days past booking date. Booking
references must be provided in order to check payment status.
6.5 Reimbursement for loss or damage to clients property caused by the model will be deducted from the models fee prior to payment.
6.6 Castings may be required before a client confirms a booking. Castings are unpaid, unless otherwise agreed.
6.7 Any Images taken during a booking are copyrighted to the client and do not belong to the model. The client may use the images for any agreed advertising.
6.8 Please always let the agency know your finish time. Without this information, we are unable to invoice correctly for any overtime.

7. Rates

7.1 Average rates payable on child photographic/Video work unless otherwise agreed
£30 per hour
£90 per half day (4 hours) £150 per full day (8 hours)
7.2 Minimum rates payable on fashion Show modelling:
£50 per day
£10 per hour (rehearsals and fittings) £40 per day (rehearsals and fittings)
7.3 Additional usage may apply to certain bookings, dependant on the client and the
territory. Travel is not always provided, this will always be stated on your booking
confirmation if it is included.

8. PK Model School (3years +)

8.1 Models Free course will be allocated on the next available course when joining the agency. The course is compulsory, as it is a positive addition to the child’s representation.
8.1.1 Cancellations with less than 1 weeks notice or no shows for the free model
school course is non transferrable.
8.1.2 50% (3 lessons) must be completed for representation
8.1.3 Attendance of less than 50% will result in termination of PK Models
Representation. Unless another course is booked (at cost)
8.1.4 Models under 3 redeem the free model course upon turning 3. this is
compulsory, no course completion will end their representation. For models
who joined prior to September 2015 (under baby enrolment) the model course
is not free and is charged at a 50% discounted price of £10.50. This is still
8.1.5 6 week Introductory Course Times:
3-6 years: Saturday 2:30-3:00pm
7-9 years: Saturday 3:00-3:45pm
10-17 years: Saturday 3:45-4:45pm
8.2 PK Model School is open all year with the exception of Easter, One Week Summer Break and Christmas. Closures are stated on notice board.
8.3 PK Model School prices are as follows:
3-6 years (30 minute class): £3.50
7-9 years (45 minute class): £4.50
10-17 years (1 hour class): £5.50
8.4 Payment for classes are paid for in quarterly blocks (12 weeks) in advance. Missed classes are to be paid for excluding closures.
8.5 Upon leaving the school written notice must be given in order to receive refund.
Refunds will be made from date of notice.
